Terms of Service

Agreement

These terms govern your use of GymMax on the web and on iOS, which is operated by the GymMax developer (“we”, “us”). By creating an account or using GymMax you agree to these terms and to our Privacy Policy. If you do not agree, do not use GymMax.

Your account

• You must be at least 13 years old, or 16 in the European Economic Area and the United Kingdom, to create an account.
• Give a real email address you control, keep your password secret, and tell us if you think someone else has accessed your account. You are responsible for activity under your account.
• One person per account. Accounts may not be sold or transferred.

Acceptable use

When you use GymMax, including when you publish to Discover, do not:

• impersonate another person, coach or brand, or misrepresent who wrote a program;
• publish content you do not have the right to share, such as another author's paid or copyrighted program;
• publish content that is unlawful, hateful, harassing, sexually explicit or deliberately dangerous;
• try to access other users' data, probe or overload the service, or get around its security or limits;
• scrape the service or use it to build a competing product.

We may remove content or restrict accounts that break these rules.

Your content

You keep ownership of the programs, notes and workout data you create. You give us the permission we need to store, process and display that content in order to run GymMax for you.

When you publish a program to Discover, you also grant us and every GymMax user a worldwide, non-exclusive, royalty-free licence to view, save, copy and adapt that program for their own training within GymMax. You can unpublish it at any time; that stops new copies but does not remove copies other users have already saved.

Not medical advice

GymMax is a training log and planning tool. Programs, weight suggestions and any other content in GymMax — including programs published by other users — are for general information only and are not medical, health or professional coaching advice. Consult a qualified professional before starting a new exercise program, especially if you have an injury or medical condition. Strength training carries a risk of injury. You train at your own risk, and you are responsible for choosing loads and exercises that are safe for you.

Subscriptions

GymMax is free to use today. We may later offer optional paid features. If we do, subscriptions bought in the iOS app are billed through your Apple ID, renew automatically at the end of each period unless cancelled at least 24 hours before it ends, and are managed or cancelled in your Apple ID account settings. Prices, periods and any free trial will be shown before you buy. Refunds for App Store purchases are handled by Apple under its policies.

Ending your account

You can stop using GymMax and delete your account at any time from Settings → Delete account. We may suspend or close an account that seriously or repeatedly breaks these terms, or if the law requires it. We may also change or discontinue the service; if we shut it down we will give reasonable notice where we can.

Disclaimers and limits of liability

GymMax is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free, or that data will never be lost. To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any injury arising from exercise you undertake, and our total liability for any claim relating to GymMax is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing.

Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded where you live.

Changes to these terms

When we change these terms we will update their version and effective date above. For material changes we will tell you in the app before they take effect. If you keep using GymMax after that, you accept the new terms.
